Looking for a power of attorney or will notary in Mississauga? Ontario wills and powers of attorney do not have to be notarized to be valid, but they do have to be signed and witnessed correctly, and many banks, land registry offices and foreign institutions ask for notarized copies or an affidavit of execution. At Notary Point, beside Square One, we handle all of that in one visit, with a lawyer in the room.
What we do
- Witness the signing of a will or power of attorney (two witnesses are required; we provide them)
- Prepare and swear the affidavit of execution that a will needs for probate
- Certify true copies of a will, power of attorney or certificate of appointment
- Notarize a power of attorney for use outside Ontario, and explain the apostille step if it is needed
Things to know before you sign
Since 2022, Ontario law no longer revokes a will when the testator later marries, and a court may validate a will that does not fully meet the signing formalities. Neither change is a reason to sign carelessly. A will or POA signed in front of a lawyer, with proper witnesses, is the surest way to avoid a dispute later. Under the Substitute Decisions Act, certain people, including the attorney and the attorney’s spouse or partner, the grantor’s spouse or partner and the grantor’s children, cannot act as witnesses to a power of attorney; we check this before anyone signs.
Need the document drafted?
Notary Point notarizes and witnesses documents you already have. If you need a will or power of attorney prepared, we can refer you to a lawyer at Law Wise Professional Corporation in the same office.

Walk in Monday to Friday, 10 a.m. to 6 p.m.; Saturdays by appointment. Because signing a will or POA takes a little longer than a simple notarization, booking ahead is a good idea if you are bringing several people.
Fees
Notarization from $50 per document. Ask us about a discount when you bring several documents in one visit. Drafting is available; the fee depends on the document and may involve additional charges, so please tell us what you need drafted and we will quote before any work begins.
Frequently asked questions
Does a power of attorney need to be notarized in Ontario?
No. An Ontario power of attorney is valid once it is signed in front of two eligible witnesses who also sign. Notarization is often requested afterwards by banks, land registry offices and institutions outside Ontario, and a notarized copy is the usual way to prove the document. We can witness, notarize and certify copies in one visit.
Who cannot witness a power of attorney in Ontario?
Under the Substitute Decisions Act, the attorney and the attorney’s spouse or partner, the grantor’s spouse or partner, the grantor’s children, anyone under 18 and anyone whose own property is under guardianship cannot act as witnesses. We supply two eligible witnesses.
How much does it cost to notarize a power of attorney in Mississauga?
Notarization and witnessing of a will or power of attorney at Notary Point starts at $50 per document, with a discount when you bring several documents in one visit. If you need the document prepared, we can refer you to a lawyer in the same office and the fee is quoted first.
Can you notarize a power of attorney for property in India, Pakistan or another country?
Yes. We notarize the signature and explain the next step, which is usually an apostille or authentication from Ontario’s Official Documents Services and, for some countries, consular legalization. See our page on documents for use outside Canada.
Do I need an affidavit of execution for my will?
An affidavit of execution is sworn by one of the witnesses to the will and is normally required when the will is submitted for probate. If you bring the original signed will and the witness who signed it, we can prepare and swear the affidavit while you wait.
